Recommendation 78:
The sector has identified increased substance use and overdoses as a result of the pandemic. The Coalition recommends low-barrier services that are implemented through a harm reduction lens, providing youth with a safe supply, and increasing the number of youth-specific treatment programs. The lack of treatment supports for youth is compounded by the risks associated with Bill 22 without the appropriate services for youth to transition into after being detained.

MCFD must work with the Ministry of Public Safety & Solicitor General to develop a comprehensive strategy for parents that are incarcerated or on parole.
- The strategy must recognize that it is not always in the best interests of the child to remove a child from a parent or guardian that has had engagement with the criminal justice system.
- There must be supports to allow parents to have access with children in prison and while on parole. For example, the government should re-open the mother and baby unit in prisons.
- The policy should set out a strategy for expediting criminal checks so that no child’s placement is delayed because of a criminal record check.

The Ministry of Public Safety should fund efforts by officers of African Descent to build solidarity amongst themselves and establish a People of African Descent community of practice for law enforcers. This is critical in leveraging People of African Descent’s agency in understanding and restoring trust and confidence in policing for the People of African Descent community at large. The Association of Black Law Enforcers provides a useful model for promoting justice and equity in policing.

The Ministry of Justice and/or Court Services Branch must update any Ministry of Justice databases (e.g. JUSTIN) and related practices, policies, and technology platforms, to ensure that the imposition of bail and sentencing conditions can be tracked in correlation with housing status and race, and that breaches of bail or sentencing can be properly recorded and searched based on the type of condition breached.

The Ministry of Housing and Municipal Affairs (MHMA) must make a province-wide commitment to supporting homeless people to maintain their belongings and to ensuring that homeless people have access to services without fear of losing their possessions. The MHMA must partner with local governments in collaboration with groups of people with lived experience, to train local bylaw officers:
- to recognize and respect the belongings of homeless people; and
- to work effectively with people experiencing homelessness to clean up or discard belongings where there is a pressing public safety, access, or environmental need to do so.

The Ministry of Attorney General should provide support to the judicial council and law society for conducting studies to understand, capture, and prioritize concerns and recommendations of judges and lawyers of African descent in terms of these bodies’ capacity in attracting People of African Descent to the profession, and of potential avenues in reforming legal practice and the justice system in BC.
